Privacy Policy

This policy explains how Markedeen Ltd ("Markedeen", "we", "us") collects, uses, and protects personal data when you visit markedeen.com, submit our contact form, or when your business contact details are processed by an AI agent we build and operate on behalf of one of our clients, inside that client's own tools.
1. Who we are
Markedeen Ltd is a private limited company registered in Scotland under company number SC793337. Our registered office is 12 Queens Crescent, Aberdeen, AB15 4BE, United Kingdom. For most purposes described in this policy, Markedeen acts as the data controller. Where our AI agents manage a client's operations and systems on their behalf, Markedeen processes any contact data as a data processor acting on that client's instructions, and the client, as the tool account holder, is the controller for that data.
2. Scope of this policy
This policy applies to three groups of people:
- Website visitors: anyone browsing markedeen.com.
- Enquirers: anyone who submits our contact form.
- Business contacts reached through client automation: individuals whose professional contact details are processed by our AI agents while managing a client's operations and systems on their behalf.
It does not cover the separate Master Service Agreement we sign with paying clients, which sets out the fuller data processing terms for that engagement.
3. What data we collect
3.1 Website & contact form
When you submit our contact form, we collect the information you provide: your name, email address, business name, website, industry, the service you're interested in, and any message you include. See Section 9 for our current cookies and tracking policy.
3.2 Data processed through client automation
Markedeen builds AI agents that manage a client's operations and systems on their behalf. When an agent is managing a client's systems, it works with contact data (such as name, business email, job title, and company) that already exists in that client's own accounts. Markedeen does not independently collect, purchase, or store this data outside of what's needed to run the automation.
4. How we use your data, and our legal basis
- Responding to enquiries: to reply to your contact form submission and discuss working together (legitimate interest / pre-contract steps).
- Automated research on enquiries: submitting the contact form triggers automated research into your business, using AI tools and public web sources, so we can prepare a more useful, personalised response before we reply (legitimate interest).
- Operating client automation: running AI agents that manage a client's operations and systems on their behalf, under that client's instructions and legal basis (typically legitimate interest, or consent where required).
- Legal & compliance: keeping records we're required to keep, and responding to opt-out, complaint, or regulator requests.
5. Who we share data with
We use a small number of third-party tools to run the business. Each processes data on our behalf, under their own security and privacy terms:
- Google Workspace (Gmail, Calendar, Drive, Sheets APIs): email delivery, scheduling, and internal data storage.
- Anthropic (Claude): powers AI-assisted research and drafting, including the automated research described in Section 4.
- OpenAI (GPT): powers AI-assisted research and drafting.
- Google AI (Gemini): powers AI-assisted research and drafting.
We do not sell personal data. We only share data with parties beyond this list where required by law, to protect our rights, or with your explicit consent.
6. International data transfers
Several of the providers above (including Google, Anthropic, and OpenAI) are based in or process data in the United States. Where personal data originating in the UK or EEA is transferred to these providers, we rely on the safeguards each provider offers (such as Standard Contractual Clauses or an equivalent UK-approved transfer mechanism) to keep that data protected.
7. How long we keep data
Contact form enquiries are kept for as long as reasonably needed to respond to you and maintain business records. Any data our agents process while operating a client's tools is retained only as long as needed to run that automation, and for up to 12 months after the client relationship ends, after which it is deleted, unless we're required to keep it longer by law or the client asks us to delete it sooner.
8. Your rights
Depending on where you're based, you have rights over your personal data. In general, you can access, correct, delete, or restrict how we use your personal data, and you can opt out of further contact at any time. To exercise any of these rights, email eni@markedeen.com.
9. Cookies & tracking
markedeen.com does not currently set tracking, analytics, or advertising cookies. If that changes, we will update this section to name the tool, explain what it tracks, and provide a way to opt out where required by law.
10. Email marketing & unsubscribing
Where our AI agents manage a client's email or communication systems, the client remains the sender of record and is responsible for complying with sender identification, address, and opt-out requirements under applicable law, including PECR and UK/EU GDPR for UK and European recipients, CAN-SPAM for US recipients, and CASL for Canadian recipients. Our agents are built to support that compliance, and we process opt-out requests promptly wherever we manage a client's tool directly.
11. Children's data
Markedeen is a business-to-business service. Our website and the automation we build are directed at business professionals, not children, and we do not knowingly collect personal data from anyone under 16.
12. Security
We restrict access to personal data to the people who need it to do their jobs, use reputable providers with their own security safeguards for storage and processing, and take reasonable technical and organisational steps to protect data against loss, misuse, and unauthorised access.
13. Changes to this policy
We may update this policy as our services, tools, or legal obligations change. The "Last updated" date at the top shows when it was last revised. Material changes will be reflected here; we encourage checking back periodically.
